Lawmakers have been hard at work creating a new Texas bill that aims to keep squatters out of Dallas homes and those around the state. A recent incident in Boca Raton, Florida drew attention to the issue of squatting when police were forced to evict Andre “Loki Boy” Barbosa from the $2.5 million home he had been squatting in. Barbosa filed for “adverse possession” with the county, an obscure law that allows squatters to move into vacant or foreclosed homes.
The case was the most valuable adverse possession attempted in Palm Beach County in ten years, and inspired several copycat adverse possession filings around the country. The new bill filed in the Texas Senate hopes to alleviate this same situation from happening here.
Filed last week, the bill would mandate that prospective squatters provide adequate written notice to the person who has a claim on the property. Sources say that without proof of this notification, county clerks would be well within their rights to reject paperwork filed by squatters trying to stake a claim on vacated property. The new bill doesn’t eliminate “adverse possession in Texas, however, it does specify that an affidavit of adverse possession is not a property title. The hope is that the new bill will help prevent misuse of the current law.
Tarrant County Constable Clint Burgess asked Sen. Jane Nelson, a Republican from Flower Mound, to sponsor the legislation.
